
Man 52, Convicted, Cautioned and Discharged
An Ekiti State High Court sitting in Ado Ekiti has convicted as charged one Dennis Agaya Kiyede, aged 52 for the offence of rape.
In his judgement, Justice John Adeyeye held that “The prosecution has established that offence of rape was committed by the accused person, I find him guilty of the offence as charged and he is accordingly convicted ”
Justice Adeyeye in his judgement stated that it is obvious that the accused is very ill as he could no longer stand on his feet, the accused who has been in custody since he was arrested must have learnt his lessons. In the circumstances, the accused is cautioned and discharged.
According to the charge, the offence was committed on or about 14/02/2019 at Ilupeju, Ijan Ekiti, when he raped his 16 yr old cousin who was living with him, contrary to section 31(2) of the Childs Rights Law, Cap. C7, Laws of Ekiti State of Nigeria, 2005.
To prove its case, the prosecutor, Mr Felix Awoniyi called 2 witnesses while the accused confessional statement was tendered as an exhibit.
The order of the Court was as a result of allocutos made by Mr Yinka Opaleke of the Legal Aid Council as Counsel to the convict, who pleaded passionately with the Court. He described the accused as a first offender, adding that he had been in custody since he was arrested and above all, he is seriously ill and can no longer stand on his feet.
