LACON giving voice to the voiceless in Ebonyi State

Judgment was delivered on 10/11/2023 in State vs. Idenyi Christian &Anor. I.e Sunday Odoh. They both pleaded not guilty to a one count charge of murder. The prosecution fielded 5 witnesses. PW 1 gave evidence as an eye witness, which we noticed some contradictions. Others didn’t link the defendants to the offence, i.e PW2 to 4. PW5 was the IPO. He gave evidence and sought to tender the confessional statements of the defendants, but we raised objection, contending that same was obtained involuntarily. The matter was then adjourned for TWT. The prosecution for 2 years could not bring the Police IPO for evidence in TWT, where in they were foreclosed amd we entered defence closing the same day. The defendants denied the commission of the offence, they were not cross examined by the prosecution. We submitted and the evidence of the IPO was expunged having not concluded same and be cross examined. The court however, relied on the contradicted evidence of PW1 as an eye witness and convicted the 1 defendant, but discharged
